LiveOps, Inc. (“LiveOps” or “us” or “we”) welcomes you to LiveWork, our website located at http://livework.com and related sub-domains (the “Site.”) Through the Site, LiveOps provides an online portal and platform for work where those seeking workers (“Clients”) can connect with an “on-demand” virtual workforce of service providers (“Providers” or “Experts.”) Clients, Providers, Experts and any other users of the Service, are referred to herein individually and collectively as “Users” or “you”. We refer to our online portal, platform, and the Site together as the “Service.”
This Privacy Policy details important information regarding the use and disclosure of information submitted by Users to the Service, as well as information collected by the Service. This Privacy Policy is incorporated into and is subject to the LiveOps Terms of Service for LiveWork. Your use of the Site and the Service and any information you provide on the Site or to the Service remains subject to the terms of this Privacy Policy and our Terms of Service.
If we decide to change our privacy practices, we will post those changes on this page. Please check this page for changes from time to time to make sure you are aware of our latest privacy practices.
Your Privacy
LiveOps recognizes that LiveWork Users value their privacy. LiveOps understands that when a User chooses to submit information to the Service, the User trusts us to act in a responsible manner. We provide this Privacy Policy to help you better understand how we protect the information submitted to the Service and who has access to the information posted by you or about you on the Service.
Who Has Access to the Service?
The Service is available only to registered Users. In order to register, a User must provide certain registration information, such as first and last name, username, e-mail address, and password. Once you give us your personal information, you are not anonymous to us. If you choose to provide us with personal information, and you are outside the United States, you consent to the transfer and storage of that information on our servers located in the United States.
What Kind of Personal Information is Collected and Stored as part of the Service?
Your basic registration information will be stored in the Service. In addition to your registration information, we may collect and store the following personal information for the purposes of providing you the Service, including but not limited to allowing you to transact business through the Service:
# your contact information (such as phone number, fax number, personal address);
# your location information (such as your time zone);
# your business status and location information (such as business address);
# financial information (such as PayPal or credit card information) that you chose to submit to us or that you chose to transmit through the Service;
# profile information (as further discussed below) that you submit through the Service;
# transactional information based on your activities on the Site (such as bidding and performing work, joining teams and workforces, completing tasks, projects, or other services, invoicing, paying or being paid for work, and content you generate or that relates to you (such as feedback) or your account);
# shipping, billing and other information you provide to post a project or to bid, perform, or pay for work;
# community discussions, chats, dispute resolution, correspondence through our Site, and correspondence sent to us;
# technical information gathered automatically as a result of your interaction with the Site, the Service, and content contained therein, such as computer and connection information and IP address and standard web log information;
# other information gathered automatically as a result of your interaction with the Site, the Service, and content contained therein, statistics on page views, traffic to and from the Site, aggregated data on how Users behave on the Site, user interactions and including any advertising or advertisement data;
# additional information we ask you to submit to authenticate yourself or if we believe you are violating Site policies (for example, we may ask you to send us an ID or bill, verify your business status, answer additional questions to help verify your identity or authority to transact business on the Site);
# information from other companies which may relate to you, such as test results from third party testing services provider ExpertRating.com;
# and other supplemental information from third parties (for example, if you incur a debt to LiveOps we will generally conduct a credit check by obtaining additional information about you from a credit bureau, as permitted by law).
How does LiveOps Use Personal Information?
Our primary purpose in collecting personal information is to provide you with the Service. You agree that we may use your personal information to:
# provide the Service and any customer support you request;
# resolve disputes, collect fees, and troubleshoot problems;
# prevent potentially prohibited or illegal activities, and enforce our Terms of Service;
# customize, measure and improve our services, content and advertising, including but not limited to running statistical analyses on the Service in order to make improvements to or otherwise promote the Service or various features thereof;
# tell you about our services, targeted marketing, service updates, and promotional offers based on your communication preferences;
# promote the Service, including by publicizing your public profile information; and
# compare information for accuracy, and verify it with third parties.
For the avoidance of doubt, this Privacy Policy is only intended to cover our collection and use of personal information as a provider of the Service, and not as a participant in LiveWork. From time to time we may also use the Service as a Client or Provider. In this case, we may collect personal information from the Client, Provider or Expert with whom we are engaging, such as, for example, the Provider or Expert’s social security number, completed Form W-9, information to validate suitability or qualifications to provide services to LiveOps, and payment remittance information. We would collect this information from the applicable Provider or Expert outside the Service, which is also what we encourage other Users to do. Information that we gather in our capacity as a participant in LiveWork (and not as a provider of the Service) are covered by our LiveOps privacy policy located at http://www.liveops.com/privacy.html.
What personal information will be made public on the Site?
Please also keep in mind that when you use LiveWork, certain information that you post to the Service will be made available to all Users. For example, although any registered User may be permitted to browse the Site without creating a profile, in order to perform any action through the Service (such as bidding for work, organizing a team, or posting projects) you may be required to create a profile as a Client, Provider or Expert. Profile information includes things like an overview of your company or business and an overview of the services you offer. Profile Information could also include a photograph of you and personal information like an overview, your address, a description of your educational background and qualifications, your work experience, skills, certifications, and your earnings and work history (such as number of completed projects and tasks, and related feedback ratings) through the Service, and other resume or portfolio information. You can control some elements of what profile information is displayed to other Users through the privacy settings of the Service. If you wish to keep your profile information private it is suggested not to complete it, but could hinder your ability to offer services on the platform.
In addition, your First name &the first initial of your last name and your Username are displayed throughout the Service and are connected to all of your activity on LiveWork. For example, all Users can see your work history, skills, test results, feedback, ratings and associated comments. All such sharing of information is done at your own risk. Although we allow you to set privacy options that limit access to certain portions of your profile (e.g. address), please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Users with whom you may choose to share your personal information. Therefore, we cannot and do not guarantee that User content you post on the Site will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Site. You understand and acknowledge that, even after removal, copies of User content may remain viewable in cached and archived pages or if other Users have copied or stored your User Content.
How are Users permitted to use the information exchanged through LiveWork?
LiveWork enables Users to share certain personal and financial information to enter into transactions. Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information we collect from you. If you disclose your information to others, whether they are Clients, Providers or Experts through the Service or otherwise, different rules may apply to their use or disclosure of the information you disclose to them. LiveOps does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. For example, Providers and Experts will often be required to submit a completed Form W-9 to the Client that contains the Provider or Expert’s Social Security or other tax identification number. Information like this should be exchanged outside the Service, such as through mail, fax, or e-mail. If you will receive personal information from another User, we encourage you to disclose your privacy practices and to respect the privacy of other Users. If you are planning to disclose personal information to another User, we encourage you to evaluate the privacy and security policies of the other User before entering into a transaction or choosing to share your information. You agree to use User information only for LiveWork transaction-related purposes or other purposes that a User expressly chooses.
Will personal information be disclosed outside the Service?
We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that any User content violates the rights of others, or protect anyone's rights, property, or safety. Such information will be disclosed in accordance with applicable laws and regulations. We may also provide information to our service providers who help us bring you the Service. Specifically, we may use third parties to facilitate our business, such as to host the service at a co-location facility for servers, to provide additional hosted services, to send out email updates about LiveWork, to process payments for products or services, to provide analytics tools or other services that allow us to analyze the performance of the Service, to provide testing services, or to provide chat, forum or telephony services. In connection with these offerings and business operations, our service providers may have access to your personal information for use for a limited time in connection with these business activities. Where we utilize third parties for the processing of any personal information, we implement reasonable contractual and technical protections limiting the use of that information to the LiveOps-specified purposes.
How does LiveOps protect personal information?
We take reasonable steps to protect the data we collect from unauthorized access, disclosure, alteration, or destruction. We do this by implementing industry-standard security procedures for storing and accessing information. However, you should be aware that we cannot ensure that all of your private communications and other personally identifiable information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), we may be forced to disclose information to the government or third parties under certain circumstances; third parties may unlawfully intercept or access transmissions or private communications; or Users may abuse or misuse your information that they collect from the Site.
What can Users do to protect their accounts?
Your password is the key to your account. Use unique numbers, letters and special characters, and do not disclose your LiveWork password to anyone. If you do share your password or your personal information with others, remember that you are responsible for all actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password.
What About “Cookies”?
“Cookies” are small pieces of information that are transferred to your browser and stored on your computer’s hard drive. Our cookies enable us to provide you with more personal service. Cookies also allow us to track usage patterns, trends and other aggregate visitor information. Most web browsers automatically accept cookies, but you can usually change your browser to prevent that if you would rather not store the information for future use. We may also collect certain technical and routing information about your computer to facilitate your use of the site and its services (such as browser type, operating system and the Internet Protocol (“IP”) address of your computer).
What about third party services offered through the Site?
We may offer links to third party sites from our Site. We may also offer third party services (such as PayPal) directly through our Site. Please note that we are not responsible for the content or privacy practices of any non-LiveOps sites. You should review the privacy policy of these third parties before using the third party services or providing any personal information.
A Note to Children and Parents:
We are committed to protecting the privacy of children. You should be aware that our web site is not intended or designed to attract anyone who does not have the legal capacity to enter into a binding contract or who is not old enough to be legally authorized to do work. The specific age requirements for the foregoing vary from jurisdiction to jurisdiction, but we do not collect personally identifiable information from any person we know is under the age of 18.
